Terms & Conditions

Terms of Payment

 All sales are made on cash/approved credit order basis. Only Wholesale customers whose credit has been approved by SpectraPure will have an open account terms of net cash 30 days, unless otherwise stated. SpectraPure reserves the right to require partial or full payment in advance or any other security at any time with any account.

•  A complete credit check is required prior to shipping on a Net 30  basis. In the interim period during which credit references are being evaluated, all orders must be shipped PREPAID (cash, cashiers check or money order). SpectraPure reserves the right to refuse to make shipments to customers who have any delinquent invoices. Customer pays all costs and expenses, including attorney's fees, incurred by SpectraPure in the collection of any sum payable by customer or in the exercise of any remedy.

•  All returned checks (due to insufficient funds or closed accounts) will be subjected to a $25 penalty charge.

•  Invoices on Net 30 accounts not paid within 30 days of shipment will be considered delinquent and will accrue Finance charges at the rate of 1.5% per month (18% per annum).

•  New accounts are welcome - we simply request three trade references with your initial order. We accept Visa®, Master Card®, American Express®, Discover®, U.S.A. check or money order.

•  Shipments outside of the USA shall be prepaid (by wire transfer, or international money order).


Wire Transfers

•  These will be subjected to a ($45 outside of the USA, $30 within the USA)  processing fee.

Transportation and Title

 •  For all sales, title and risk of loss transfer to customer F.O.B. point of shipment. As a service, SpectraPure may at customer's request prepay freight charges, but Customer is still responsible to secure insurance on goods once shipment has left the shipping point. Customer expressly agrees to indemnify and hold harmless SpectraPure against any and all claims arising out of any loss, delay or damage in transit.

•  Spectrapure cannot be held liable for damage or loss to a shipment by a freight carrier. Check shipment for damage before acceptance or note on freight bill subject to inspection for concealed damage. Consignee must file claim. Spectrapure will offer as much assistance as possible.


Return of Goods

Shipping charges on units or parts submitted to our facility for repair or replacement must be borne by the registered purchaser. After repair or replacement, the factory will return the unit or part freight prepaid to the customer.

We assume no warranty liability in connection with our equipment other than as herein specified.

This warranty is in lieu of all other warranties expressed or implied, including warranties of fitness for a particular purpose.

We do not authorize any person or representative to assume for us any other obligation on the sale of our equipment. This is the exclusive remedy and liability for consequential damages under any and all warranties which are excluded to the extent exclusion is permitted by law.

Proof of original purchase date must accompany all warranty claims.

SpectraPure, Inc. reserves the right to change prices without notice when necessary. All prices in the catalog are quoted in US dollars.

Claims for error in quantity or condition must be made within 10 days of receipt of material. SpectraPure, Inc. will not be responsible for any claimed shortages not reported within 10 days. Returns other than warranty claims may be subject to 20% restocking fee.

SpectraPure, Inc. cannot be held liable for damage or loss to a shipment by a freight carrier. Check shipment for damage before acceptance or note on freight bill subject to inspection for concealed damage. Consignee must file claim. SpectraPure, Inc. will offer as much assistance as possible.

Delivery

Date of shipment promised at any time prior to actual shipment is based on SpectraPure best judgment at the time said date is given and may be changed by Spectrapure Inc on account of circumstances both within and beyond Spectrapure Inc reasonable control. Under no circumstances will SpectraPure assume responsibility for any damages or claims resulting from delays in delivery.

 
Responsible Practices

Customer will (i) familiarize themselves with and product literature or information SpectraPure provides (also refer to updated materials and references on web site: www.spectrapure.com ) (ii) follow safe handling, use, selling, storage, transportation, and disposal practices, including special practices as Customer's use of the goods require, and instruct its employees, contractors, agents and customers in these practices, and (iii) take appropriate action to avoid spills or other dangers to persons, property or the environment. Customer will indemnify SpectraPure for all claims, damages and related costs, including reasonable attorney fees arising out of Customer's noncompliance with any of its commitments under this paragraph. ALL WATER SYSTEMS SHOULD BE MONITORED FOR POTENTIAL LEAKS FOR A PERIOD NOT LESS THAN 72 HOURS UPON INSTALLATION TO VERIFY PROPER LEAK FREE OPERATION.

Methods of Payment

1. Terms of payment are Net 30 days with established credit. 2. Wire Transfers: US BANK TO BANK wire transfers $35, INTERNATIONAL $45 .
